Assumption of Risk, Release & Waiver, and Photo Liability

Welcome to Rising Star Pilates (“Company,” “we,” “us,” or “our”). By accessing or using our website, booking system, and services—including in-person classes, private sessions, workshops, and events—you agree to comply with and be bound by the following Terms. If you do not agree, please do not participate in our services.
1. Acceptance of Terms
By booking or attending a class, you confirm that you are at least 18 years old (or have parental/guardian consent if under 18) and have the legal capacity to enter into this agreement.
2. Services Provided
Bendit Pilates offers Pilates classes, movement-based workshops, wellness events, and related activities. Additional terms may apply to specific services and will be provided when applicable.
3. User Accounts & Bookings
- Some services may require creating an account through our booking platform.
- You agree to provide accurate information and maintain the confidentiality of your login credentials.
- You are responsible for all activity under your account.
4. Payments & Refunds
- All fees for classes, packages, or events must be paid at the time of booking.
- Fees are non-refundable unless otherwise required by law or explicitly stated in writing.
- We reserve the right to change pricing and service offerings at any time.
5. Cancellations & No-Show Policy
- Class cancellations must be made within the time frame outlined on our booking platform.
- Late cancellations or no-shows may result in forfeiture of class credits or fees.
6. Conduct & Safety
You agree to:
- Use our services for lawful purposes only.
- Treat all instructors, participants, and staff with respect.
- Follow all instructor guidance to reduce the risk of injury.
We reserve the right to refuse service or terminate participation if conduct is unsafe or disruptive.
7. Intellectual Property
All class materials, images, videos, and other content are the property of Rising Star Pilates and protected by copyright. They may not be copied, distributed, or used without our written permission.
8. Assumption of Risk
I acknowledge that participation in Pilates and related physical activities carries inherent risks, including but not limited to:
- Muscle strain, sprains, falls, or joint injury.
- Injuries due to negligence of myself, other participants, or instructors.
- Risks from equipment failure, improper use, or environmental hazards.
I confirm I am physically capable of participating and have no condition that would endanger myself or others. I understand that any participation is voluntary and at my own risk.
9. Release & Waiver of Liability
In consideration of being allowed to participate in Rising Star Pilates classes, events, or services, I release and discharge Rising Star Pilates, its owner, instructors, contractors, and affiliates from any and all claims, liabilities, or demands arising out of or related to my participation—including claims arising from negligence. This release applies to me, my heirs, executors, and assigns.
10. Indemnification
I agree to indemnify and hold harmless Rising Star Pilates and its representatives from any claims, damages, or expenses (including attorney’s fees) resulting from my actions, omissions, or violations of this agreement.
11. Photo & Media Release
I grant Rising Star Pilates the right to take and use photographs, videos, and other media of me during classes or events for marketing, social media, and promotional purposes, without compensation. If I do not consent, I will notify Bendit Pilates in writing prior to participation.
12. Arbitration & Governing Law
This agreement shall be governed by the laws of the State of [Your State]. Any disputes will be resolved through binding arbitration, and I waive my right to a jury trial.
